Article 3 Any unit, organization or individual (hereinafter referred to as the informant) has the right to report major hidden dangers of accidents and illegal acts of production safety to the production safety supervision and Administration Department of the people's government at or above the county level, other departments responsible for the supervision and administration of production safety, and the coal mine safety supervision institutions at all levels (hereinafter referred to as the departments responsible for safety supervision)

Article 4 the departments responsible for safety supervision shall follow the principles of "legitimate reporting, appropriate reward, territorial management, hierarchical responsibility" and "Whoever accepts it will be rewarded"

Article 5 the "major accident hidden danger" mentioned in these Measures refers to the hidden danger that is very harmful and difficult to rectify, and should be completely or partially shut down, and can be eliminated only after a certain period of rectification and treatment, or the hidden danger that is difficult to be eliminated by the production and business operation entities due to external factors

the determination of major potential accidents in coal mines shall be in accordance with the provisions of the criteria for determining major potential accidents in coal mines (Order No. 85 of the State Administration of work safety). The determination of major potential accidents in other industries and fields shall be in accordance with the determination standards formulated by the Department responsible for safety supervision and released to the public

Article 6 the illegal acts of work safety referred to in these Measures shall be identified in accordance with the principles stipulated in the measures for the investigation and punishment of illegal acts of work safety (ajtzf [2011] No. 158) issued by the State Administration of work safety, focusing on the following situations and acts:

(1) those who have not obtained the relevant work safety license or incomplete, expired or unchanged licenses to engage in production, operation and construction activities; Engaging in production and business operations without obtaining approval or acceptance according to law; Engaging in production, operation and construction activities without authorization after being closed down and banned; Stop production for rectification, integrate technical transformation, organize production without acceptance, or violate the "three Simultaneities" Regulations on safety facilities of construction projects

(II) fail to carry out work safety education and training for employees according to law, or fail to pass the examination of work safety knowledge and management ability according to law. 1. (V) the organization undertaking safety evaluation, certification, testing, inspection and occupational health technical services issues false certificates

(6) concealment or false reporting of production safety accidents, concealment or non reporting of major potential accidents, or failure to rectify within the prescribed time limit, or the escape of the main person in charge of the production and business operation entity after the occurrence of casualty accidents

(7) failing to carry out "three Simultaneities" of occupational disease prevention facilities according to law, or failing to carry out occupational disease hazard detection and evaluation according to law

(VIII) other production safety violations stipulated by laws, administrative regulations, national standards or industrial standards

Article 7 if the major potential accidents and illegal acts of work safety reported by the informants are not found by the production and business units and the departments responsible for safety supervision, or if they are found but not handled according to the relevant provisions, and are verified to be true, the informants will be given cash rewards. Reports made by staff members who are responsible for the management, supervision and supervision of work safety and their close relatives or others under their instigation shall not be rewarded

Article 8 the matters reported by the informant shall be objective and true, and shall be responsible for the authenticity of the contents reported, shall not fabricate or distort the facts, and shall not falsely accuse or frame others and enterprises; Otherwise, once verified, the informer shall be investigated according to law

Article 10 the following provisions shall apply to the verification and handling of the reported matters of major potential accidents and illegal acts of work safety:

(1) the local departments responsible for safety supervision at all levels shall be responsible for accepting the reported matters within their respective jurisdictions

(2) the departments responsible for safety supervision of the local people's governments at or above the level of cities divided into districts and the relevant state departments responsible for safety supervision may directly verify and handle the reported matters within their jurisdiction according to their respective responsibilities

(III) the reporting matters of various coal mines shall be checked and handled by the local coal mine safety supervision department within the jurisdiction. The coal mine safety supervision institutions at all levels shall report to the local government in time the reports directly received by the coal mine safety supervision institutions involving major hidden dangers of coal mine accidents and illegal acts of safety production, and cooperate with the local coal mine safety supervision departments to check and deal with them

(4) the coal mine safety supervision department of the local people's government and the coal mine safety supervision institution shall communicate with each other before checking the reported matters of coal mines to avoid repeated verification and reward

(V) if the reported matters do not fall within the scope of acceptance of the unit, the Department responsible for safety supervision shall inform the informant to report to the unit with the right to deal with them, or transfer the reported materials to the unit with the right to deal with them, and take appropriate measures to inform the informant

(6) the Department responsible for safety supervision that accepts the report shall timely check and handle the reported matters, and shall complete them within 60 days from the date of acceptance; If the situation is complicated, the time for verification and handling may be appropriately extended with the approval of the Department responsible for safety supervision at the next higher level, but the extension period shall not exceed 30 days, and the informant shall be informed of the reasons for the extension. If it is impossible to find out due to the limitation of verification means, it shall be reported to the relevant local government in time, which shall take the lead in organizing the verification

Article 11 if the investigation proves to be true, the Department responsible for safety supervision that accepts the report shall give a cash reward to the meritorious real name informants according to the following provisions:

(I) for the reporting of major accident hidden dangers and illegal production, operation and construction, the reward amount shall be calculated according to 15% of the amount of administrative punishment, with a minimum reward of 3000 yuan and a maximum reward of 300000 yuan.
